1. Definitions & reservations

1. Definitions

The following definitions are used in the terms and conditions below:

“Association” The Cooperative Association “Sole Mio” u.a.

“Sole Mio” Holiday Park “Sole Mio” located in Gera Lario (Italy).

“Tenant” The consumer who rents a bungalow at the park, either online via the Website, or by telephone or e-mail via Customer Service.

“Park Manager” The Dutch-speaking park manager located at the park.

“Customer Service” The organization that handles the offline (telephone and written) rental of the bungalows on behalf of the Association and provides information to (potential) Tenants.

“System Management” The organization that manages Sole Mio’s online booking system.

“Website” The official website of the Association, www.solemio.nl, including the online booking system offered thereon. “Online Booking” A reservation made independently by the Tenant via the booking system on the Website, without the intervention of Customer Service.

“Distance Contract” The rental agreement concluded via the Website, by email, or by telephone, without the simultaneous physical presence of the Association (or Customer Service, System Administration, or the Park Manager on its behalf) and the Tenant, within the meaning of Article 6:230g et seq. of the Dutch Civil Code.

“Rental Price” The rental price as stated by the Association on the Website.

“Booking Confirmation” The confirmation of the reservation, which is automatically sent by email in the case of an Online Booking immediately after completion of the booking process and the first payment.

“Rental Period” The period for which the Tenant has rented a bungalow on the Association’s park. This is usually a period from Saturday to Saturday.

“Rented Property” The bungalow on the park chosen by the Tenant. “Rent Due” The rent due for the Rental Period.

“Additional Costs” Costs and fees for additional services, such as extra cleaning, equipment rental, or a surcharge for pets, as well as administrative costs.

2. Reservation and Rental of Bungalows

A Tenant may make a reservation in three ways: (a) directly and independently via the online booking system on the Website (Online Booking), (b) by telephone via Customer Service, or (c) by email to Customer Service. In all cases, the Tenant indicates for which period and which type or number of bungalow he wishes to rent, and which additional amenities and services are desired.

The Association only processes reservations – online and offline – from persons who are 23 years of age or older. By making a reservation, the Tenant declares that he meets this age requirement. The Park Manager may request valid identification upon arrival; if the Tenant proves to be younger than 23 years of age, access to the Rented Property may be refused without entitlement to a refund. The Association reserves the right to refuse deviating reservations, particularly those made by groups, without providing reasons. This also applies to Online Bookings; in such cases, the Tenant will be notified of this, and any amount already paid will be refunded.

Sole Mio rents out bungalows during the periods indicated on the Website and via Customer Service. Rentals take place in one-week periods, commencing on Saturday and ending on Saturday. Customer Service may deviate from this in consultation with the Tenant; only periods currently available can be booked via the Website.

In addition to the rental of the Rented Property, the Rental Prices include the use of gas, water, and electricity within the Rented Property, bed linen, towels, and the final cleaning of the Rented Property. The current Rental Prices and any surcharges are clearly displayed for an Online Booking prior to the completion of the booking, including a specification of the Additional Costs. Any tourist tax (imposta di soggiorno) levied by the municipality of Gera Lario is not included in the Rental Price and must be paid on-site to the Park Manager.

The Association charges administrative fees per reservation. For an Online Booking, these costs are displayed separately in the booking overview before the Tenant definitively confirms the booking.

For a reservation made via Customer Service, Customer Service assigns or rejects a bungalow based on the request and availability. For an Online Booking, the Tenant chooses a bungalow themselves based on the availability displayed by the booking system at that moment.

Upon assignment by Customer Service, the Tenant receives a Booking Confirmation (see Article 3 for Online Booking). The Tenant must check the Booking Confirmation for accuracy immediately upon receipt and report any inaccuracies to Customer Service immediately.

2. Online bookings

3.1 Conclusion of the Online Booking • The booking process on the Website comprises at least the following steps: (1) selection of period and bungalow, (2) selection of any additional services (such as a cot, bed-making or bringing pets), (3) a summary screen showing the full Rental Price, Additional Costs and the total amount, (4) entry of personal and contact details, and (5) confirmation of the booking, after which the Tenant is immediately redirected to payment. • The Distance Contract is concluded at the moment the Tenant definitively confirms the booking on the Website and the first payment has been successfully processed. The Tenant then immediately and automatically receives the Booking Confirmation by e-mail. • Before completing the Online Booking, the Tenant is given the opportunity to check the information he has provided (period, bungalow, additional services, personal details) and to correct it if necessary, before the booking with a payment obligation is concluded. 3.2 Accuracy of information on the Website • The Association takes the utmost care to ensure that the availability, prices and other information stated on the Website are accurate and up to date. Obvious errors, typos or mistakes (including manifestly incorrect prices) on the Website are not binding on the Association. • If, after an Online Booking has been placed, it emerges that a technical fault has resulted in an incorrect price, incorrect availability or a double booking, Customer Service will contact the Tenant as soon as possible to correct this. If no suitable solution can be offered, the Tenant is entitled to cancel free of charge and to a full refund of any amounts already paid. 3.3 Online payment • Payment for an Online Booking is made using the payment method offered in the confirmation (such as Wero or bank transfer). Payments are processed by a recognised external payment service provider via a secure (SSL/TLS-encrypted) connection; the Association has no access to, and does not store, complete payment details. • Online Bookings are subject to the same payment schedule as other bookings (see Article 4): the first instalment of 50% of the Rent Due plus 100% of the Additional Costs must be paid immediately upon completion of the Online Booking, and the remaining 50% no later than 6 weeks before the start of the Rental Period. The Tenant will receive a timely e-mail reminder for payment of the second instalment. The absence of a reminder does not release the Tenant from his payment obligation. • If an online payment is not processed successfully, no booking with a payment obligation is concluded and the Tenant will be informed accordingly. 3.4 Right of withdrawal for Online Bookings • When a rental agreement is concluded at a distance (online, by telephone or by e-mail), consumers in principle have a statutory right of withdrawal. However, pursuant to Article 6:230p(e) of the Dutch Civil Code, this right of withdrawal does not apply to contracts for the provision of accommodation where the contract provides for a specific date or period of performance – which is the case for the rental of a bungalow at the park. • This means that the Tenant is not entitled to the usual 14-day cooling-off period in which to withdraw from the contract without giving reasons. The Association expressly draws the Tenant’s attention to this before the Online Booking is completed. • The foregoing is without prejudice to the cancellation provisions in Article 5 of these conditions. 3.5 Mandatory information for distance contracts • In accordance with Article 6:230m of the Dutch Civil Code, before concluding a Distance Contract the Association provides the Tenant with at least the following information (on the Website and/or in the Booking Confirmation): the identity and visiting address of the Association, the Chamber of Commerce number [Chamber of Commerce number], the VAT identification number [VAT number], the contact details of Customer Service, the main characteristics of the Rented Property, the total price including taxes and Additional Costs, the method of payment and performance, the applicability of these conditions, and the information on the (absence of the) right of withdrawal as set out in Article 3.4.

3. Payment & cancellations

4. Payments • For an Online Booking, the first payment must be made immediately after the booking process (see Article 3.3). For a booking via Customer Service, the Tenant receives a Booking Confirmation with the request to pay 50% of the Rent Due and 100% of the Additional Costs to the Association within 1 week of the date of the Booking Confirmation. • The Tenant must have paid the second instalment of 50% of the Rent Due to the Association no later than 6 weeks before the start of the Rental Period. • If a payment is not received on time, the Association is entitled, after a written reminder, to cancel the reservation and to rent the Rented Property to third parties. In that case, the cancellation provisions of Article 5 apply accordingly. 5. Cancellation and cancellation insurance • Cancellations can only be made in writing, by e-mail to Customer Service. The date of receipt of the e-mail determines the amount of the cancellation costs. • If a reservation is cancelled by the Tenant, cancellation costs are payable. For cancellations up to 6 weeks before the first day of the Rental Period, these amount to 50% of the total of the Rent Due and the Additional Costs; for cancellations from 6 weeks before the first day of the Rental Period, they amount to 100% of that total. • The Association advises the Tenant to take out cancellation insurance. • If the reservation is cancelled by the Association due to force majeure (including natural disasters), the Tenant will, where possible, be offered an alternative of at least comparable quality. If no suitable alternative can be offered or the Tenant does not accept it, the Association will refund the amounts already paid by the Tenant. Any further compensation is excluded.

4. Arrival and departure

6. Arrival and departure • The Rented Property is available from 4:00 pm on the agreed day of arrival. • On arrival, the Tenant receives the keys to the Rented Property and a welcome pack from the Park Manager. • The Park Manager will not admit more persons than the maximum number for which the bungalow has been rented. • Pets are only permitted under the conditions of Article 8. • The Tenant inspects the Rented Property upon moving in and immediately reports any defects or complaints to the Park Manager. If, in the Tenant’s opinion, any defects or complaints have not been adequately dealt with by the Park Manager, the Tenant must report this to Customer Service immediately. • On the agreed day of departure, the Rented Property must be vacated before 10:00 am. The Tenant hands over the Rented Property to the Park Manager in a broom-clean condition by returning the key. • On departure, the Tenant must empty the dishwasher, take out the household waste and empty the bins (see Article 9). • If the Tenant leaves the Rented Property before the agreed date, the Tenant is not entitled to a refund of (any part of) the Rent Due and/or the Additional Costs.

5. Inventory

7. Inventory • On arrival, the Tenant must check the standard inventory. Missing or defective items must be reported immediately to the Park Manager, who will arrange for replacement. • The inventory may differ between bungalows. It is not permitted to take inventory items to other bungalows. • Bed linen and towels are provided in the Rented Property. The Tenant must bring his own tea towels and beach towels. • The Tenant, users and those accompanying the Tenant are jointly and severally responsible for orderly conduct in and around the Rented Property and elsewhere on the park, and for the proper use of the Rented Property and the equipment in it. • The Tenant is jointly and severally liable for damage caused by breakage, loss and/or damage to the inventory or the Rented Property. Any damage must be reported by the Tenant immediately to the Park Manager and paid for on site, unless the Tenant can demonstrate that the damage is not attributable to the fault of himself or other users of the bungalow. • The Association is not liable for theft of the Tenant’s belongings from the bungalow or from the park.

6. Pets & park management

8. Pets • No pets are permitted during the period stated by Customer Service or on the Website (roughly the months of July and August). • During the other periods when the park is open, a maximum of 2 pets per bungalow is permitted in a limited number of bungalows. • If the Tenant wishes to bring pets, this must be stated at the time of reservation – online or offline. In that case a surcharge will be charged to cover the additional cost of the final cleaning. • The Association reserves the right to refuse pets on the park (without giving reasons). • Pets must be kept on a lead outside the bungalow. Pets must not cause any nuisance to other guests and are not allowed in the children’s pool. 9. Park management • The current opening hours of the Park Manager are announced on the Website and at reception. • The Park Manager will endeavour to provide the Tenant with the requested information and to answer questions about the Rented Property, Sole Mio and the surrounding area. • Vehicles may only be driven at walking pace on the park. Cars and other vehicles must be parked behind the Rented Property so that the view from the bungalows behind is not blocked. • For the time being, there are no facilities for charging electric vehicles on the park. It is not permitted to charge an electric vehicle at the Rented Property. • The Tenant must place household waste and glass in the designated containers at the back of the park. • There is a children’s pool on the park. Its use is free of charge for the Tenant and is at the Tenant’s own risk.

7. Privacy and data protection

10. Privacy and data protection • When making an Online Booking, completing the booking form or using the Website, the Association processes the Tenant’s personal data (such as name, address, e-mail address, telephone number and payment details) only to the extent necessary for the conclusion and performance of the rental agreement and the processing of payment. The Association does not use this data for marketing purposes without the Tenant’s prior consent. • The Association processes this personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation, as further explained in the privacy statement published on the Website. • Personal data is not kept for longer than is necessary for the purposes for which it was collected or than is required by statutory retention periods (including the tax retention obligation), and is not disclosed to third parties other than parties involved in the performance of the contract (such as the payment service provider and the Park Manager) or where the Association is legally obliged to do so. • The Tenant has the right to request access to, correction or deletion of his personal data; such a request can be addressed to Customer Service using the contact details on the Website. Data that is still needed for the performance of the contract or that must be retained under a statutory retention obligation will only be deleted once this is permitted. 11. Cookies and use of the Website • The Website uses cookies and similar technologies, among other things for the functioning of the booking system, for measuring website use and – only with the visitor’s consent – for marketing purposes. Further information can be found in the cookie statement on the Website. • The Association endeavours to ensure that the Website functions properly, but does not guarantee that the Website will be available at all times without errors, interruptions or security issues. The Association is not liable for damage resulting from temporary unavailability, faults or maintenance of the Website, unless the damage is the result of intent or deliberate recklessness on the part of the Association or of persons it engages in the performance of the contract (such as Customer Service, the System Administration and the Park Manager). • If an Online Booking cannot be completed (correctly) due to a fault on the Website, the Tenant can still make the reservation by telephone or e-mail with Customer Service, under the same conditions as stated on the Website.

8. Complaints

If something is wrong during your stay, tell reception straight away. Whatever we can fix on the spot, we fix on the spot. If we cannot work it out together, the law of Italy applies, the country where the park is located.

9. Complaints & amendment of the conditions

12. Complaints, disputes and applicable law • Complaints about the performance of the contract must be submitted by e-mail to Customer Service as soon as possible, and in any event within two months of being identified, stating name, Rental Period, bungalow number and a clear description of the complaint. Complaints during the stay must first be reported to the Park Manager (see Article 6). • These conditions and all agreements between the Association and the Tenant – including Online Bookings – are governed by Dutch law. • Disputes that cannot be resolved by mutual agreement will be submitted to the competent court of the District Court of Midden-Nederland (Rechtbank Midden-Nederland), Utrecht location, without prejudice to the Tenant’s right to opt for the court with jurisdiction under the law within one month after the Association has invoked this clause in writing. 13. Amendment of the conditions • The Association may amend these conditions from time to time, among other things to bring them into line with laws and regulations or with the booking process on the Website. The version of these conditions published on the Website at the time of the (Online) Booking applies to that booking.
